As used below, "we" and "us" means the owner(s) of cocoads.com. "You" means anyone who buys pixels from www.cocoads.com and/or visits the cocoads.com homepage. When you lease pixels from cocoads.com, you acknowledge that you have read and agreed to the following Terms & Conditions:

• When you lease pixels from www.cocoads.com, you agree and understand that you are leasing only the right to display an image or message and link to a URL from the cocoads.com homepage, leasing the pixels throughout the duration of the time reservation set forth within the "Terms & Conditions". You are not leasing or buying any right or interest in or to the cocoads.com website, its owner, or any other sites that advertise on cocoads.com.

 

We agree to post your image or message and URL link on the cocoads.com Homepage for three years from the date in which your pixels are published. Thereafter, you will have the choice to renew your lease on cocoads.com and keep the same location if desired, change the location if other spots are available, or terminate your lease so that the leased space becomes available for someone else to use.

• You represent and warrant that you have the right and authority to submit the images, messages and URL links that you submit to us. You agree not to submit images or messages and URL links that belong to someone else or infringe on someone else's copyrights, trademarks or rights. If you submit an image or message that turns out to be owned by someone else, we will remove the image or message and you will not be given a refund.

 

• Once you submit your request to advertise in the spaces available, complete payment for the spaces reserved, and receive approval from the site administrator, NO REFUNDS will be given to the party or parties that purchase the right to advertise in the pixel advertisement space.

• We will not post on the homepage of cocoads.com any image, message or URL link that contains or leads to adult (pornographic), terrorism, offensive or obscene content. We have the sole and arbitrary right to reject any submission we consider inappropriate and obscene. If you submit such images, messages or URL links, you understand that you will not be given a refund and your images, messages or URL link will not be posted on cocoads.com. If, after your URL link is posted on cocoads.com, you change the URL to point to inappropriate, offensive or obscene material, we have the right to permanently remove your image, message and URL link from cocoads.com, and you will not be entitled to notice or a refund.

 

• Once your image or message and URL link are accepted and published on cocoads.com, and then you decide you want to change your image or message and URL, you may do so by login in to the account you created initially. The same "Terms & Conditions," apply and we will go through the entire process of accepting or rejecting the changes. If your new image, message or URL contain adult, terrorism, offensive, or obscene content, your request for change will be cancelled and your account will be suspended until you provide a suitable alternative. If you neglect to provide a suitable alternative, the advertisement will be taken down and the space will become available to the general public. In the event that your space is reassigned, there will be NO REFUNDS given to the advertiser's account.

 

• We don't have control over any links or content that appear on a website once you leave cocoads.com by clicking on the image or URL leased on the homepage. If compliance isn't met accordingly to the "Terms & Conditions" set forth on this page, we may suspend and cancel any violator's account. In addition, we are free from any responsibilities and liabilities from any and all services, purchases, actions you choose to take, and the consequences thereafter, of any webpage you access through the cocoads.com homepage.

 

• If you would like for your link or advertisement to be removed in the future for any reason, it will be removed. However, if a link is removed as requested by the customer, NO REFUND will be given for the pixel advertisement space.

 

• When advertising on cocoads.com, the customer must have all authority to advertise the link, content, and/or picture as governed by Copyright and Trademark laws in the United States of America and the State of California.

 

• cocoads.com will not sell, rent or exchange your personally identifiable information to anyone.

 

• cocoads.com reserves the right to modify or update the "Terms & Conditions" as we see fit.

 

• cocoads.com, if required by law, may send personally identifiable information about you, if and only if, we respond to subpoenas, court orders, or legal process due to any of your actions on our web site that violate the cocoads.com "Terms & Conditions."

 

• You agree that all images, messages and URL links you submit to us will be in the following format:

1. Images must be in the exact size you have paid for. One square block is equal to 100 pixels. Therefore, if you bought a 10 blocks for the cocoads.com homepage, you must submit an image no greater than 1000 (10 x 100) pixels.
2. Images must not be animated and will not be accepted. No exceptions.
3. Images must be *.jpg or *.gif format only.
4. URL links must point to web pages only. Links must begin with http:// or https:// to be considered valid links. If at the time of reservation, a suitable URL is not available you must enter the phrase RESERVED in the URL field.
5. You agree to release and hold us harmless from liability for displaying and linking to any images, messages and URL links you submit to us.
6. We will post your image, message or URL link within 48 hours after your funds have cleared, provided your submission complies with the above "Terms & Conditions."
7. Some links, banners, or images on cocoads.com are posted as link exchanges. The images and text are are that of the respective site owners and will only link to their respective sites.
8. All content posted must abide by the laws of the State of California.
9. Be aware that site down-time can exist and in the event of site down-time for maintenance or other issues, NO REFUNDS will be given for lost traffic. We do not anticipate this problem and in the case of maintenance, any and all down-time will be kept to a minimum.
10. No warranty will be given to the amount or quality of traffic that you will receive and just as well no guarantee is given as to how much traffic you will receive.
11. We reserve the right to increase or decrease the pixel advertisement price in the future.
